He just plain killed it. I've seen it 4 times now in the theatres. he really gets better each time. He must have centered his life around this role, he probably spent his off-screen time still impersonating this madvillain. I think he deserves an Oscar regardless of being alive or dead. With that said, if Daniel D. Lewis drops a bomb this year and is better I'll vote for the more deserving actor. But, I do not expect anyone anytime soon to drop a performance like Mr. Ledger did.
